The rules of the road for using FCE One. We tried to keep the legalese to a minimum and put the important stuff first.
Effective July 27, 2026Governed by Michigan law
Last updated: July 27, 2026·Version: 2026.07
These Terms cover every role on FCE One — shopping the marketplace, listing products, running a hub, shipping as a business, or delivering as a driver. Role-specific agreements still apply where presented in-product.
Who you buy from
Items Sold & fulfilled by FCE One are sold by FCE One (merchant of record). Independent marketplace listings are sold by that seller — FCE One provides the platform, payments, and logistics tools.
Returns & refunds
Listing return windows and our Buyer Protection rules apply. See the full Return Policy for steps and timelines.
Multi-role platform
Customer, seller, hub, business, and driver portals each have clear responsibilities and acceptable-use rules.
1. Acceptance of these Terms
By creating an account, placing an order, shipping a package, listing a product, or otherwise using the FCE One platform (the "Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you don't agree, please don't use the Service.
2. Your account
Age depends on the role. Personal shopping and Network accounts are for people 13 and older. Seller, hub, business, and driver accounts are for people 18 and older, or the age of majority where they live. Keep your password secret and enable two-factor authentication.
Customer / personal accounts: 13+. Teen Network profiles start private, stay off search and leaderboards, and do not see personalized ads.
Seller, hub, business, and driver accounts: 18+ (or the age of majority where you live).
You agree not to impersonate anyone, share your account, or open multiple accounts to evade suspension.
3. Platform roles
FCE One serves multiple roles, each with its own additional agreements:
Customers — browse, buy, and ship.
Sellers — list products, fulfill orders, and receive payouts.
Hub partners — receive, store, and fulfill inventory.
Business shippers — originate shipments at volume.
Drivers — pick up and deliver packages.
Role-specific terms (seller agreement, hub agreement, driver addendum, etc.) are presented in-product before onboarding. These Terms cover what applies to everyone.
4. Acceptable use
You agree not to use the Service to:
Ship anything prohibited by carrier, federal, or state law (weapons, regulated goods, hazardous materials outside of an approved program, etc.).
Sell counterfeit, pirated, stolen, or otherwise illegal goods.
Harass, threaten, or harm anyone — buyers, sellers, drivers, or FCE One teammates.
Circumvent security controls, scrape at scale, or attempt to reverse-engineer the Service.
Misuse promotions, chargebacks, or referral programs.
We may suspend or terminate accounts that violate this section. Serious violations are reported to law enforcement.
5. Purchases, shipping & payments
When a listing says Sold & fulfilled by FCE One, your purchase contract is with FCE One as merchant of record. For independent marketplace seller listings, your contract is with that seller — FCE One provides the platform, payments, and (in most cases) shipping tools.
Shipping quotes are estimates until a package is scanned at our facility. Final pricing is shown before charging. You authorize us (or our payment processor, Stripe) to charge your saved payment method for completed purchases and approved shipments.
Taxes and customs duties are the customer's responsibility for cross-border shipments.
6. Returns, refunds & disputes
Refunds and returns follow the listing return policy (and FCE One’s retail return rules for Sold & fulfilled by FCE One items) plus our Return Policy , plus Help Center guidelines , whichever is more protective of the customer. Final-sale and no-return listings must be clearly labeled. Disputes are handled through in-app support first; unresolved disputes go to arbitration as described in Section 12.
7. Your content
You own the content you post (listings, photos, reviews, messages). By posting it, you grant FCE One a worldwide, royalty-free license to host, display, reformat, and promote it — only as needed to run the Service.
You represent that your content doesn't infringe anyone else's rights. We respond to valid DMCA notices at legal@fceone.com.
8. Our intellectual property
The Service, the FCE One name and logo, and all associated software, designs, and content are owned by FCE One or our licensors. These Terms don't grant you any rights to use our brand. Need assets? Visit the Press page.
9. Warranties & disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, FCE One disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Your use of the Service is at your own risk.
10. Limitation of liability
To the maximum extent permitted by law, FCE One's total liability to you for any claim arising out of these Terms or the Service is limited to the greater of (a) the amount you paid FCE One in the 12 months before the claim, or (b) $100. We are not liable for indirect, incidental, special, consequential, or punitive damages.
11. Suspension & termination
You can close your account anytime from Account → Security. We may suspend or terminate your access if you violate these Terms, create legal or safety risk, or go dormant for more than 24 months.
We'll try to resolve issues informally first — email legal@fceone.com. If that doesn't work, disputes will be resolved by binding arbitration under the rules of the American Arbitration Association, in Troy, Michigan, on an individual basis (no class actions), except claims eligible for small-claims court.
13. Changes to the Service or Terms
We may update these Terms from time to time. When we make material changes, we'll post the new version here and notify active users at least 30 days in advance by email and in-app notice. Continuing to use the Service after the effective date counts as acceptance.
14. Miscellaneous
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. If any section is held unenforceable, the rest stays in effect.
